Some of the general principles of civil liability due to negligence include; a breach in the duty of care on the part of the service provider, a breach of duty, and also a direct cause. They apply to negligence in the aviation field where failure to address them may lead to civil liability (Ruwantissa 79). Some of the practices that companies and/or individuals may undertake to reduce their liability include the incorporation of standard terms. This involves contractual agreements that offer certainty and consistency through partnerships.

Also, contracts may assist in determining the extent of a party’s obligation in the event of potential negligence suits. The choice of law and clauses in a jurisdiction may also be a prudent way of mitigating risk and liability. Allowing for the possibility of a dispute during the provision of service in a performance contract is a way in which companies and/or individuals can reduce the extent of their liability (Ruwantissa 86).Aviation insurance is usually for the risks involved in the field of aviation, and the operations of the aircraft.

For flight instructors, having a combined single limit insurance cover guarantees that the aircraft and its occupants are covered against potential harm. This cover takes care of both passenger and public liability, which provides flexibility for all persons and property in and outside the aircraft. For full-service FBO operator, ground risk hull insurance not in motion is the preferable insurance cover. This is usually for events that may occur that are not within the operator’s power, for example, a hangar collapse.

This type of insurance may guarantee that the aircraft is compensated depending on the agreed value at the time of purchasing the policy (Ruwantissa 92). Airport operators and owners must have public liability insurance, which is sometimes referred to as third party liability. It covers them for any damage that may be done to houses, crops, cars, and other facilities within the area. Passengers are also compensated for losses incurred by the insurance company. This ensures that everyone is reimbursed for all the trouble.

The aircraft, however, is not covered in this insurance cover (Ruwantissa 94).
