The MD code provides in 8-208 (a) (1) that landlords having more than five units must offer written lease, and that rule came to effect on 1st of October 1999. In this regard, Flops & Flats, Inc. is bound by that particular provision.

8-208 (a)(2) provides that in case the landlord fails to comply with the provision requiring written lease, the tenancy period would only be one year unless a tenant, through one month notice, elects to end the tenancy earlier than one year.

Reading the two provisions together implies that the landlord-tenant arrangement was extinguished upon the conclusion of one year which fell during the period when the boyfriend of the lady in apartment three left. In this respect, there is no legal landlord-tenant relationship between the lady in apartment three and Flops & Flats, Inc.
