Its applications have taken place in many conflicts at the international level, especially after 1990 there has been a lot of emphasis on the application of this humanitarian intervention. One basic controversy among all the issues discussed or condemned under humanitarian intervention is of violation of human rights whether that was a civil war situation or ethnic cleansing crisis or mass killings or demonstrations but one main commonality was the negation of human rights by the state itself. This dissertation will discuss those cases and their controversies before and after the humanitarian intervention, the successes of the intervention and failure of this doctrine, and the acceptance of this regime as Customary International Law.

Presently, Syria and Egypt are the center of attention for the international community due to their ongoing conflict of oppression by the government and the demonstrations by the government to contain the crisis. According to the recent Health Ministry of Egypt reports, the initially injured stats in the August 2013 crisis stand around 3,994, and hundreds of protesters were reported of being arrested. Within the last one-week death toll has crossed 650 causalities among civilians only in August. The severity of the death toll in Egypt indicates that it is no more a safe place to live. The UN Office of the High Commissioner for Refugees (UNHCR) expressed its reservations about the crisis mentioning that Egypt is the second biggest host country providing shelter and livelihood to refugees in the Arab world. Furthermore, UNHCR is not entitled to intervene in their domestic or national matters till Security Council authorizes them to intervene.

However, UN SC has not yet decided on any intervention in Syria. Taking account of the severity of the circumstances; the question emerges of what kind of intervention is promising to solve the crisis in this case where member states i.e. Russia and China have a tendency to reject the concept of intervention arguing about the consequences of intervention beside violation of sovereignty. The answer is a challenging task and has been a trial for many authors in recent years. Analyzing the practices of the 1990s, which propose different instances of humanitarian intervention (authorized and non-authorized) and non-intervention, these analyses of the 1990s will help develop and understand the legal framework and options for intervention. In addition it is very important to discover the truth about humanitarian intervention which has consequently led to the new norm emerging such as the doctrine of ‘Responsibility to Protect (R2P)”.

The theoretical framework of the Humanitarian Intervention has made it apparent, that HI has lots of conflicts and controversies in its implementation. Most importantly the prime conflict of opinion is on the violation of fundamental principle of state sovereignty which comes in contrast as use of force is processed against a sovereign state.
