Case Study: The ICO Conference Analysis: The ICO conference is held after every two and a half year. The conference held in 2004 was a very good experience. It was held under the supervision of Professor Markham who is also the president of the organisation. For all these years she has taken the responsibility of organising the conference right from the scratch. Not only deciding the content of the conference but from where the conference will take place and how every thing will be covered in it. From her past experience she has been great success as all the arrangements made out by her were bringing great result and she was satisfied with how thing were going. She was convinced that in coming year, if things will be favorable the conference result would be very same. For Professor Markham, Organising and taking sole responsibility of the conference arrangement was very effective and some how she was happy with the way things were moving and it was satisfying for her. She overlooked one fact that taking all possible responsibility can sometimes be very risky and thing can go out of control. She was very well aware of the fact the importance of the conference and she has been planning well ahead for the preparations, which is normal way of taking things. All she was not aware of the situations and their consequences and she was not probably prepared to handle it. At certain stages focuses are bent on different thing rather than forecasting a certain situation. Last year conference took place in a hotel and it was a great success and Professor Markham was rather very happy with their management. Till the next conference the situation was not same as now the same hotel was not under the same management as it was before. It was one of the external affect that was overlooked. It was one of the threat that could possible have a negative affect on the conference or if lucky would have been positive on the conference but at some point there was risk of not looking at the fact the there were a slight chance that new management would have not taken the thing as it was done by the old one. Now that Professor Markham was aware that the hotel in which the conference was to be held was under different management. She was told that things would be different as they were with the old management; her decision was very critical at this stage. She would have decided to hire a new hotel or stick with it but the crucial factor was of time. She agreed the management but on different terms. She compromised on money but she didn't make sure she is expecting even better services. She would have given even more money to another hotel, which in otherwise would have guarantee services that she was looking for. By this way, she paid more money and resulted in poor services. Decision at such stages is quite crucial but it might be difficult for one person to decide the importance of the consequences. Professor Markham had other work to do for the conference and this part was ignored which became a disaster for her. Professor Markham should have taken strict notice under the management of the new hotel as to per what law advice; the contracts remain same in the case if the hotel owner is changed. Contracts are made under the hotel name, which are transferable. Questions: 1. Identify and explain the real and/or potential legal issues involved in the case, and suggest how they might have been overcome. There are certain issues involved in the case that are debatable. Under all circumstances whenever a contract is made, they are active until their time is over. In case of certain circumstances, when the medium under which the contract is made is sold. The buyer is meant to agree with all the contracts that are active under the name. Under law when the hotel was sold, to whomever party it was sold, the new management has to agree with all terms and conditions of the contract without having it renegotiate. On the first place, the contract should not have been renegotiated but as it was done a formal report of the previous conference should have been made. Professor Markham should have presented the new management with a formal report of all the services that the old management agreed and served her. She should have renegotiated to raise the price only if the new management agrees to provide the same standard of services that she was expecting. Professor Martha was indeed not in a position to threat the management of any inconvenience they were creating. She probably would have discussed it with the management after the conference was offer. This probably would have given her some concession or at least it was worth trying. 2. Assume you are a Professional Conference Organiser who has been engaged by Professor Markham to plan and stage the Association's 2008 annual conference. Professor Markham is still upset by the experience of the 2006 conference - how can you reassure her that similar problems will not occur in 2008 My first job would be to make a formal report of the conference held at 2006 and point out the leaps hole that might have lead to a failure of the conference. It is clear that the same hotel will not be used again for the conference in 2008, so my next job will be to look for another hotel. For selection of a hotel, it would be one that will offer me good services with reasonable price. I would probably look for a hotel that holds good reputation. I would also demand a report of the achievements she had in the conference held in 2004.This will give me an idea of the kind of services she is looking for. I would prepared a budget report and approve of the budget first. This will give her the assurance that at any moment before the conference I will not turn up and say that the budget is going out and she will have to pay more money. By approving a budget she will be relieved from any expenses associated with the conference. With the budget in my hand, I will write a report that will cover all the conference arrangement and will make sure that professor Markham understands all the terms in the report and how the things will be done and what would be the result. Through the report Professor Markham would get the rough idea of the outcome of the conference and the work I will be doing. I will assure her that she does not have to worry about how the outcome will be produces and what efforts will be put in to get the result. By this way I will be responsible for the result and the consequences and my all devotions will be on it. She will only pay if the result goes as written in the report I have shown to her. By this she will trust me and will be assure about the result.
