Human Rights and Family The term ‘Human Rights’ refers to the fundamental rights and freedom enjoyed by the human beings. It mainly deals with the individual rights and responsibilities. Traditionally inherited concept of Human Rights has a long historical back ground. One of the greatest advantages of human right is that all humans are treated equally. These rights are universally applicable and ignore differences in the concepts of religion, sex, culture etc. Human right includes a collection of various principles and laws. The concept of human rights is based on the principles that lead people towards the right path. In order to maintain these rights in an effective manner, every nation should formulate certain laws and rules that ensure the well-being of its citizens. In the present scenario, we find a tremendous growth of population and it is very essential to make reconsiderations of the strategies that are adopted to maintain human rights. Lack of mutual understandings among people is, in some cases, the reason for the distress faced by them. The provisions of human rights are very essential for the existence of the framed laws and regulations. “The promotion and protection of all human rights and fundamental freedoms must be considered as a priority objective of the United Nations, in accordance with its purposes and principles, in particular with the purpose of international cooperation. In the framework of these purposes and principles, the promotion and protection of all human rights is a legitimate concern of the international community. The international community must treat human rights globally, in a fair and equal manner, on the same footing, and with the same emphasis. The Platform for Action reaffirms the importance of ensuring the universality, objectivity and non-selectivity of the consideration of human rights issues”. (The United Nations Fourth World Conference on Women 2005). It is necessary that all people fulfill their appropriate responsibilities and obligation, for the purpose of protecting the fundamental human rights in a most effective manner. More importantly, the appropriate provisions of human rights are also taken in to consideration about the code of conduct and other ethical principles. The adequate norms and policies of human rights are properly maintained by the political and legal enactments of various countries. Human rights of a person include personal freedom, economic, cultural and social freedom, equality etc. As per the legal frame work, every person is treated in an equal manner. Even more important and essential requirement is that we stress aspects like equality, accountability etc. So, we need to provide appropriate human rights provisions in a better manner. “The key principles in CROC are: the right to survival and development respect for the best interests of the child as a primary consideration the right of all children to express their views freely on all matters affecting them the right of all children to enjoy all the rights of the Convention without discrimination of any kind”. (Senate Legal and Constitutional Committee's Inquiry into the provisions of the Family Law Amendment (Shared Parental Responsibility) 2005). But any type of violations of these human rights cannot be justified. Such a violation would mean the exploitation of fundamental human rights. Misuse of human rights may some times lead to conflict as well. The cultural aspects of the human rights are usually criticized. Certain cultural or religious sectors may provide restrictions for fulfilling the primary rights of a human. One of the main reasons for this argument is that of lack of education. “Violence against women and girls represents a global health, economic development, and human rights problem of epidemic proportions and cuts across all countries, social groups, ethnicities, religions, and socioeconomic classes.” (Women’s Human Rights. 2007). The term ‘family’ is has particular cultural values. This particular concept has been developed in a significant manner during the recent years. Family means a group of people holding a set of cultural values. In a family, there should be mutual understanding among the family members. Family law provides a clear understanding about the adults and children in a family. This particular law emphasizes the various family related matters and concepts. The cultural and religious attitude of a human may reflect from his family values. Family status and values that determines the position of a particular person within a society. Moreover, there should be a proper co-ordination and mutual understanding which is very relevant in this regard. The concepts of family differ in special point of view. The term ‘family’ is a concept that is having a strong base and generally family means parents with one or two children living in a house. But they all share their feelings, there should proper co-ordination, mutual understanding and commitment. “The family has basic functions. In order for the family to meet a child's psychological needs, its members must be nurturing, convey mutual respect, provide for intimacy, and engage in bonding and attachment. The family also socializes the child, guiding the child to be members of the society beyond the family. The family conveys religious and cultural beliefs and traditions to the next generation. The family is the child's source of economic resources, which meet the child's various physical needs for food, shelter, and clothing. Then, too, the family sees to it that the child receives health and dental care.” (Family 2007). In the context of family, the term ‘Marriage’ is having an important role. So, in a practical point of view, family means marriage and links to children. During recent days, the living standard of the people also got changed, this will automatically affect the family life style also to a certain extend. Even though the term family is having a worthwhile meaning, it should also have its own limitations. The concept of Human rights may sometimes creates different interpretation in a particular nation. Technology and human rights are related to each other in certain point of view. Major issues related with the technological effort are that lack of competition. The life style of people, the cultural impact and the ethical principles are related with the human rights in an effective manner. The absence of mutual understanding among the humans may sometimes leads to misappropriate the fundamental human rights. The legal frame work of a country may stipulate about the primary duties and responsibilities of a human, and how to carry out such responsibilities effectively, and what all are the implications. In addition to this, now the human right is also giving importance for the education of people. It is one of the prime necessary in the ordinary life of a human. Human rights of a person mainly consists of his freedom in the matter of right to live, right to speak, right to travel etc. “The European Union Charter of Fundamental Rights sets out in a single text, for the first time in the European Union's history, the whole range of civil, political, economic and social rights of European citizens and all persons resident in the EU. These rights are divided into six sections: Dignity Freedoms Equality Solidarity Citizens' rights Justice”. (The Charter of Fundamental Rights of the European Union. 2001). For the overall development of a nation, it is essential that we properly carry out the basic rights and responsibilities framed by the Government. Population context is one of the main facts behind the economic development of a nation. A citizen of a country should responsible for fulfilling his rights and obligations as framed by the legal and administrative authority of a particular country. The fundamental rights may increases the legal certainty of the citizens of a nation. Moreover, it ensures the certainty and security of the people in a larger way. As far as an economy follows the fundamental human rights, it takes all sets of people into in to consideration and treats them equally. Even in the case of a business entity, people want to preserve the human rights in their interest. Business enterprises should provide adequate remuneration to its employees in a reasonable manner, which makes a corresponding change in to the life style of employees. Educational field is taken in to consideration; primary education for all humans is a necessity. Rather than this, the humans of a nation are also responsible for fulfilling their obligation in respect of environmental protection also. Human right is a fundamental guarantee that all individuals will carry out their obligations and responsibilities in an effective manner by keeping their morality and code of conduct. Human Right is a common frame work enacted by legal administration which determines the economic, political, cultural and social requirements of an individual. The behavioral attitude of a person is ultimately reflected from their family value and the religious and cultural morality. Human rights are such rights which may relate to the ordinary life style of a particular individual. Human rights are mainly of moral and legal rights. Proper understanding and effective implementation of these two rights are crucial in nature. Legal rights are those which are framed or enacted by the law of legislation, and its effective fulfillment and compliance is necessary. In addition to this, the violation of legal rights shall be punishable in nature. Law means a fundamental body of jurisdiction, and the misconduct of legal principles is quiet hazardous. But on the other hand, the moral rights are not that much risky. Basically it is related with certain moral rules and policies. The accomplishments of moral rights are not compulsory, which may or may not related to the international laws and administration. In addition to this, as far as human beings are considered, certain other rights like claim rights, liberty rights, power rights, and protection rights are existing, but these are not as relevant as legal and moral rights. The protection of human rights is very important, so it is essential to ensure the global security of such rights. By giving stress for the context of human rights, people shall perform their duties in a co-ordinated manner, because the concept of human rights created from moral rights. “The impression that many have of human rights as being unduly utopian testifies less to the inherent demands of human rights and more to the extent to which even fairly modest aspirations are so far from being realized in the world today. The actual aspirations of human rights are, on the face of it, quite modest. However, this should not distract from a full appreciation of the possible force of human rights. Human rights call for the creation of politically democratic societies in which all citizens have the means of leading a minimally good life. While the object of individual human rights may be modest, the force of that right is intended to be near absolute. That is to say, the demands of rights are meant to take precedence over other possible social goals.” (Human Rights 2006). The main theme of human rights shall be recognized and effectively exploited by people of certain group under certain circumstances. The concept of human rights is also gives protection for the family life. Human rights guarantee the personal dignity of all citizens. Moreover, there should be a proper relation between the human rights principles and labor administrations. By taking the human rights as a whole, it is clear that there are certain kinds of rights that are peculiar to women. So, women’s rights are also described as human rights. Therefore, it is necessary to safeguard the human rights of women. But then also, women and girl children is suffering certain violation against their human rights, which is mainly due to their gender. “Women's contribution to equality in Latin America and the Caribbean brings to the fore two key issues in the structural pattern of inequality between women and men: first, political participation and gender parity in decision-making processes at all levels, and, second, women's contribution to the economy and social protection, especially in relation to unpaid work.” (Women’s Contribution to equality in Latin America and the Caribbean 2007). The terms human right and family are related to each other under several circumstances. A family is considered as the basis of the society and cultural values. The various rights of individuals shall contribute something good to the society or nation. Some times, the concept of human rights may passes through the values and attitudes of the family. The effective utilization of the basic human rights will helps to improve the overall personal dignity. Human rights which improves the virtue of civilization. So, it is very essential to taken in to consideration about the fundamental human rights and the impact of family status. Human rights are the political rules and principles, by which people are responsible to fulfill their obligations. Some of the important rights enjoyed by humans are right to freedom of religion, right to travel, right to take part in the political programmes etc. Similarly, it also mentions that rather than these rights political rights, social rights, environmental rights etc. One of the basic reason for the existence of human right is that the passing out of certain laws and regulations.
