Case Study, Business Affiliation Notice to Leave Premises Landlord Tenant Following the recent behavior as evident by the condition of the apartment rented to you, I write you this notice to vacate the apartment within the next two weeks. Your living condition is very wanting and brings out a bad personal image that may hardly satisfy the characteristics of tenants to which I indent to rent my apartment. Your living condition provokes a health hazard to the rest of the tenants living within this building and at the same time, such conditions create an alarm to the dangers facing the loss of my property.

The same issue proves that the light dimmer you requested to be corrected was initiated by the causes, specifically the problems leading to the same environmental condition within your rented apartment. I thus wish to file a case in case you are not willing to give in to my polite notice since you seem to go against the contractual agreements (Douglas, 2002). I can suggest that the problems being corrected were created by you due to the same behaviors. The dimmer switch gets warm when you leave it on for at least three hours due to your carelessness.

The same applies to the toilet, which is filling slowly. You may not be the direct cause of the problem but the visitor you invite to your house seem to have little or no care for my property and this is problem calling for the breakdown of all these facets. Damage to property by tenant is against the law (Koster, 2013). The solutions to these problems are further creating additional costs to my business despite being a threat to my property. I therefore request you to vacate the house within the stipulated time failure to which I would take a court action.

Answer from tenant Your notice leave your premise is unlawful since there is hardly any consideration of the number of times I have complained about the dimmer light switch as well as the filling toilet. I have been complaining about the same problem for about three months without any response. I would be unkind and unlawful to give eviction notice without giving any notice for any bad or unlawful conduct within your premises (Koster, 2013). The lease has not expired and for that reason, it would be difficult to terminate the terms of contract between the property owner and us as a tenant.

According to law, a contract may be terminated only if one party fails to accomplish the requirements of one aspects of his or her side of the contractual agreement. The fact that you found my rented apartment stuffy or unkempt does not imply that I am a bad person, who by the law should not be living within the apartments. I had a visitor, and despite that, I left the house in harry leaving it stuffy. My visitor has no obligations to have it clean and that is why he cared less. The house conditions you found does not picture who I am.

You should thus not relate them to the damage you had to cater for (Koster, 2013). I therefore need the cancellation of such notice since I have legal right to live within my rented apartment. Court Case The Landlord The offender is my tenant who has declined my request to vacate my apartment following the damage he has caused or would cause to my property. The tenant has been hasty and has no care for other people’s property. Through his behavior, I can project the magnitude of damage he/she may cause to my property.

He/she has been reluctant when it comes to health within my premises. The same case has been the reason why the toilet within his/her apartment has been filling, which has never happened with any other tenant within my rental properties. He has been careless with fixtures like electricity leading to the damage of the dimmer light switch within his/her apartment. He occasionally welcomes intruders within my property premises who hardly observe health measures. Besides, he allows some socially prohibited conducts within my premises such as watch pornographic movies in noisy volume (MacMillan & Stone, 2012).

I thus ask the court to assist me with having him/her evicted from my premises and pay me the damages caused by his ruthless behaviors. Tenant Argument My landlord has been unkind when dealing with his tenants. I pay his rent in time and I have observed all contractual agreements over the entire time I have been in his premise. I always keep my house clean and in case the house remains untidy, this has nothing to do with the tenant-landlord agreement we had. I have been busy with personal matter, often not sleeping within my apartment, which is the reason I asked one of my relative to check on my apartment while I am out.

The person left to look at my house is hasty as I came to note. Before asking him in, I had asked my landlord to check on the dimmer light switch and the problem behind the toilet in the apartment. This was the third request with the first two requests to fix the same problems failing. This was the only time the landlord turned up but on the wrong day, when I was not in personally. His eviction notice further comes without warning (Koster, 2013). I therefore plead innocent of the charges and I would ask the court to charge the landlord misconduct towards his tenants.
