Land development claims are often overlooked by the public. This case of Evaporation, Inc. versus the Bureau of Land Management (BLM) reveals the intricacies of practice. Here, we explore two pressing questions about the circumstances as presented in the brief.Was the review of the project by the BML engineer administrative rulemaking or was it adjudicationThe review decision by the BLM engineer was administrative rulemaking. The BLM is not a court of law nor is it a legislative body; therefore, the decisions it makes that have legal weight are neither laws nor adjudications but only administrative rules.

Furthermore, the decision was not based on any sort of litigious conflict. There was really nothing to judge. It was all about whether or not the mine met certain criteria according to previous patterns of practice.Will the suit stay in Federal Court or will it go back to the BLM adjudicative branchThe suit will go back to the BLM adjudicative branch. If the adjudicative branch is unable to rectify the situation, the case could be taken to a higher court.
