Assaultive Offenses News by Slattery, NG and Lestch, provides a case in New Jersey where an individual walked into a house and started beating up the woman in front of her daughter and a nanny cam (which recorded all the assault on camera). This was later followed by burglary of the woman’s ring and other valuables. The man also came back the second time still uninvited and this time he also found the husband was in the shower and he escaped with other valuable possessions in the house. The news article says the camera recorded the man brutally beating the woman severally and seriously assaulting her.

The man was arrested and is awaiting trial and is being charged with assault which is attempted murder, child endangerment, burglary and robbery. The incidence took place on the 28th of June, 2013. According to McCollach and Kinkeade, if the case took place in Texas, the offense the man committed would be charged as a Class C. misdemeanor, under section 22.01 of the Texas Penal Code. This is so because the man intentionally and knowingly caused bodily harm to the woman when he beat her. The assault against the woman under section 22.

01 subsection c is a class C. misdemeanor and not a felony because the woman is not a public servant, elderly or a sports participant and the suspected man has no relationship whatsoever with the woman he assaulted.
