The matter was referred to Adult Community Corrections Service for the preparation of Pre-sentence report. The Pre-sentence report was duly completed and it is attached for the information of the Court. With regard these offences Clarke accepted that she was caught trying to life good worth $52 from K-Mart. Clarke claimed that on that day her daughter did not have nappies and food and she had to get it for her from the shops. She at first cooperated with the cooperative security staff but was agitated when told that the police would be contacted. She even tried to run away and she was verbally and physically aggressive to the guards who tried to retrain her. When asked about the money she had in her pockets and why did she not use it to but the items, Clarke she not want to use the money on those items (food and nappies) and wanted to save some money for herself. She wanted to use the money to go out with friends and bribe her brother with pot in order for him to look after the kids. She also wanted to use the money on hard substances and alcohol. Clarke claimed that drinks and drugs made her feel good. It was a way of escaping the reality in her life. Clarke accepted that she often used prohibited substances hence the presence of methamphetamine in her jacket in the course of the police search. Clarke informed that he smoked pot and used alcohol with friends. On the account of being found with prohibited drug Clarke tried to blame someone in the circle of her friends who introduced her to the drug as a remedy when feeling low and a way of escaping her misery. Clarke said she has been using methamphetamines for the past six months and she only used on weekends but got hooked eventually. Clarke said she did not use the everyday but quite often in a week. Clarke claimed despite her use of drugs and alcohol her children were well taken care of as a neighbor and her brother looked after them. COURT HISTORY Emma Clarke has no previous court history. She was only issued with a Cannabis Infringement Notice four year ago that needed her to pay a fine. Clarke paid the fine and records at Fines Enforcement Registry show that she has no outstanding fines. Emma does not have any other offences. RESPONSE TO PREVIOUS SUPERVISION Having no other previous offences there is no record on previous supervision. Clarke has not been convicted in any court of law prior to these offences. FAMILY BACKGROUND Emma was born 29th September 1992 in Western Australia. She was born in Perth in in King Edward Hospital. Clarke reported that she brought up with both parents until she was 15 when her father died. Her father died seven years ago. She loved her father so much and memory of him is of a jovial and entertaining person. He took the children out for fun and went fishing on the beach. Her mother remarried a year after her father’s burial. Clarke turned to her aunt for comfort and consolation. The aunt understands her, but her mother did not care about their wellbeing except for her own happiness. Her aunt distanced herself when Emma use of drug became apparent. Clarke has sister aged 10 and a bother aged 19. Emma and her brother do not want to have any contact with their mother. The younger sister lives the mother and has rare contact with Emma. Emma Clarke claims that she got fired due to excess absenteeism. She was a casual employee at Woolworths and worked for about eight months when she was 21. She did a hairdressing apprenticeship at 19 but quit when she got pregnant. Emma has a cordial relationship with her siblings but despises her mother. Clarke did not enjoy her schooling days. She informed that the teachers and subjected were boring. She hated her teachers and thought that they hated her too. She sees it as an achievement that at least she finished Year 12. She enjoyed playing netball at school but she could not cope with trying every Sunday morning and opted out. Clarke do drugs and drink with friends. She reported that she does not do methamphetamines with friends. She got into using methamphetamines recently after a recommendation from an acquaintance. She uses it to escape the reality of messed up life. MARITAL SITUATION Emma is a single parent. Emma moved in with her partner at 17. Her partner first left when their firstborn was born and then when the second born was conceived. They have not had contact since then. He claimed that he was irritated by the noise babies. He has not had contact with Emma since then. EDUCATION AND EMPLOYMENT Emma reported that she attended school at completed Year 12 but quit school when she could not bear further the resentment of her teachers. She did not like or enjoy school. She did not give her best in school because she did not like it. She informed that teachers and subjects were boring. Emma initially enrolled for a hairdressing apprenticeship course but had to discontinue when she fell pregnant. She worked at Woolworths until she was recently terminated from that position for missing work frequently. Emma worked at Woolworths for eight months when she was 21. Emma has not considered looking for other types of jobs since being fired from Woolworths. She reckons it never works out but really liked her hairdressing apprenticeship that she quit after getting pregnant. She does not like working due to her bad luck on the job. FINANCIAL SITUATION Emma was previously enrolled in apprenticeship of hairdressing but quit when she fell pregnant. She was recently terminated from working at Woolworths stores for missing workdays. Emma is not employed and currently survives on single parent payment as the only source of income. SUBSTANCE USE Four years ago Emma was issued a Cannabis Infringement Notice four years ago that needed her to pay a fine. She started abusing drugs at an early age. She reported using drugs from time to time. Emma informed of smoking pot and drinking with friends mostly on weekends. She spends a good part of her money on drugs. She uses drugs to try at forget the frustrations she is going through in life in her life. Emma started using methamphetamines six months ago after a friend introduced it to her. She begun by using it on weekends but uses it quite often in recent times. Emma smokes the drug with a pipe. Her aunt distanced herself when Emma drug problem grew worse. Emma uses methamphetamines after a day. She uses drugs when she is bored and has nothing better to do in her life. Emma expressed unwillingness to work with a counselor on her drug problem before considering finding a job. She is unwilling to take a urine test after counseling to prove whether she is clean. SUMMARY AND RECOMMENDATIONS Emma did not deny charges against her and claimed that she needed the items for her daughter. She did not want to spend money she had since she had preserved it for going out with friends, buying drinks and drugs besides paying her bother with pot to remain with the children at home. Her unemployment and use of drugs drives Emma to petty offending like shop-lifting. Emma does not have any Court History or previous response to supervisions since he has never been sentenced. The issue of a Cannabis Infringement Notice four years ago shows that Emma started using drugs when she was 18 years. In the interview Emma was willing to talk about her drug problem although she trivialized the degree of her problem. Emma partner seemed to be the one who introduced her into hard drugs since he was caught selling to students. The frequent use of methamphetamines sets her on a course of being fully addicted. The use of drugs eats a big possession of her single parent income. Emma has emotional issues that have not been addressed in her life. Emma became distraught after the death of her father and felt that her month married another man after his death. Her aunt was the only person she could talk to since she felt her mother had betrayed her and her siblings. Peer influence has forced her into drugs and unnecessary spending where she is forced to go out every weekend. Emma feels empty and has psychological issues that can be addressed by either a counselor or a psychiatric. Emma is a first offender and she has not been convicted in any court of law except the drug infringement notice. Emma has a negative attitude towards counseling although she has never attended any session before. Counseling can help Emma to overcome her drug problem. With the right company and support, Emma has a chance of cleaning up from drugs. Community-based sentence is appropriate for Emma and counseling sessions to help her deal with her drug problem. She has previously involved in hairdressing apprenticeship and show same interest in that. Counseling and encouragement can make her force towards hairdressing and hence find a source of income. The counseling sessions should be compulsory and made as one of the requirements of the community-based sentence. Emma feels neglected since the death of her father and seemingly no one cares about her especially when she started using drugs. This Pre-sentence Court Report recommends that rehabilitative service should be provided to Emma and monitored counseling sessions should conditions for any parole to be considered. A community-based sentence will give her a chance to attend to her children.
