Basing my reasoning on all the statutes that determine burglary I do not believe the client committed the alleged offense. All the clients’ actions can be argued not to amount to the offense in question. It is not my belief that the client committed burglary by entering his neighbor`s house and stealing a television set. The crucial statutes which determine the act of burglary include unlawful entry into the building or any part of the building, intention to steal the television set at the time of entry, and the statutes of the building or dwelling place that have not been met (Cromwell, 74).

The burden of proof will lie with the prosecution to prove that the client had an actual intention to commit the crime of stealing the television upon entry into the neighbor’s house. Since the neighbor was away at work when the client allegedly entered his house, there are possible reasons that the client went to the neighbor`s house to check on him (Cromwell, 70). The actual intention of going to the house was well wished on finding out the well-being of the neighbor as opposed to stealing the television set.
