Victimology number Project number: 40601600 Violence and property crime Crime is a term used to describe all activities that violate the political and moral norms of a society, especially when it comes to standards that are backed by legal sanction of the state. Criminal perpetrators of the good are called criminals. Fighting crime is one of the main tasks of the state apparatus, and it is implemented through its prevention that is usually in charge of the police, or the punishment of the perpetrators who carried out the judiciary. There are plenty of crimes, but the ones we will discuss are violent and property crime. Violent crime indicates the relationship between the two parties in which one party or using the threat of force affecting the other side. Under this crime, there is murder, rape, robbery and assault. Suicide or murder in general terms, is every human act which results in the immediate death of another man. He is also using the term homicide, which comes from the Latin word homo (man) and cedere (cut). In the strict sense of the murder is considered only the seizure of someones life that is contrary to law, and is often cited as the definition of unlawful taking or unlawful deprivation of life. In almost all countries and in their legal systems and criminal law murder is considered for one of the most serious crimes, and it accordingly regulate. Rape in the broadest sense is the act by which a person is forced to participate in sexual activity against their will or by using violence, threats or use of the fact that this person due to the illness or intoxication that activity is unable or refuse to deal with it. In almost all human societies, and the laws of all states are considered the most serious of all sexual offenses. Theft is committed act of seizure movable property and immovable property with the intent to unlawfully appropriate.Property crime is crime done to someone property; when villain is violating in any way property of victim that is called property crime. Under this crime, there is burglary, larceny, vehicular theft and arson.Burglary is illegal entry into a building for the purposes of committing an offence.Larceny is a crime where someone involves the wrongful acquisition of the personal property of another person.Vehicular theft is a criminal act where someone steals, or tries to steal someone`s vehicle. In the end, arson is the crime where villain intentionally and maliciously set fire to buildings, cars or other property with the intent to cause damage. All of these crimes must have victims involved. Victim can be offended, damaged or physically threatened. Every community is affected by these crimes, and that is one of the plagues in our society. In my county crime rate is higher than in another ones in my State. Crime rate per 100,000 people is: murder 4, rape 11, robbery 134, and assault 158. In New Jersey, the phrase of jail time for killing, including imprisonment of 3 decades to life jail time without the likelihood of parole. For the offense of rape would be punished as 3rd degree crimes, with a maximum sentence of 5 years. When a person is charged with robbery he faces imprisonment for a maximum of 30 days to punishment for life imprisonment without the possibility of parole. The offenses are presented in order of seriousness, and given a numeric level, 1 through 7, representing each of the grades provided for in the criminal code. Aggravated assault, Larceny-theft, Motor vehicle theft and burglary are also treated the same. The amount of complete aggressive criminal activity victimizations dropped by 13% in 2010, which was about three times the normal yearly reduce noticed from 2001 through 2009 (4%). The decrease in the amount of simple attack included about 82% of the complete decrease of the amount of aggressive victimization in 2010. In 2010 the residence victimization amount dropped by 6%, compared to the normal yearly loss of 3% noticed from 2001 through 2009. From 2001 to 2010, weapon attack (26% to 22%) and stranger-perpetrated attacks (44% to 39%) dropped. Between 2001 and 2010, about 6% to 9% of all aggressive victimization was dedicated to fire arms. This amount has stayed constant since 2004. After a minor overall decrease from 2001 to 2008, the amount of affected individuals of aggressive criminal offenses who suffered an injury during the victimization increased from 24% in 2008 to 29% truly. About 50% of all aggressive victimizations and nearly 40% of residence criminal offenses were revealed to the police in 2010. These rates have stayed constant over the past 10 years. Therefore, our jurisdiction must be much more effective and more careful with criminals. Curfews, driving ban after 11 minors, frequent police controls and stronger police forces on the streets; that is differencing my county from another ones. In addition, there are enhanced penalties for criminals, burning conditions in prisons and much more that will and a lot of things to distract criminals from crime Battered Woman Syndrome There are plenty of questions about this syndrome, but the common one is: what are psychological reasons for woman to stay with abusive husband? ` The build of Battered Woman Syndrome (BWS) has been designed as a subcategory of post-traumatic stress problem (PTSD). It is consisting of the following symptoms: re-experiencing the battering as if it were reoccurring even when it is not, efforts to prevent the emotional effect of battering by preventing actions, people, and feelings, super excitement or super cautious, disturbed cultural connections, body picture distortions or other somatic problems, and libido and closeness problems (Walker, Lenore E. 1984). Traditionally, society responded to this case in many ways. Some people are thinking old way like woman is guilty of something and husband has right to beat her. The modern ones are against any violence against woman. In the last years, woman gained more rights than ever; so on the courts victim woman will gain police defense, every legal right against the villain and right to not showing up on court in front of the villain. Prosecutors are more willing to get right into the hands of victim and they are doing the best they can to prevent further violence. In my county, affected individuals of household assault are secured by law with security and right to data file a municipal issue under the Avoidance of Domestic Violence Act, along with a legal issue. Both problems should be registered for your security since the municipal issue is developed to secure you and the legal issue is developed to penalize the addict. A Rape Care Advocate from the county Rape Care Center is available to everyone 24 hours-a-day to go along with sufferers through all medical, legal and court procedures. Rape Care Advocates can provide psychological support and information to you and your significant others, as well as explain your options. Individual and group guidance is available at each nation Sexual attack Care Center. All services and fees are private, and are available regardless of when the attack occurred or whether a sufferer reviews the criminal activity. If the attack occurred within the past five days and sufferer is over the age of 13, the nation Sexual Assault Reaction Team (SART) can be triggered. Megan`s Law "Megans Law" is the informal name for a set of laws that are binding in the United States security agencies to make available information about registered sex offenders. These data usually include photos, address and nature of crime offenders. On Saturday September 29, 1994, 7-year old Megan Nicole Kanka vanished. With the guarantee of a dog, her next door neighbor, Mark Timmendequas, attracted her into his home where he raped, strangled and covered her. Her body system was loaded into a nasty toy chest area, and thrown out in a close by recreation area. Megan had been murdered by a two-time authorized sex perpetrator who resided across the road from the Kanka home and was discussing his home with two other charged sex violators that he met in jail. (Fodor, Margie D. 2001) Sexual abuse of children is illegal in every developed country and range will vary from those in our country as well as to life or the death penalty. In America, there are known cases where abusers get a few hundred years. All the caution must be made to a certain extent, because in Russia for example in the past few years, the number of sexually abused children is 25 times higher. In America, it is recorded more than half a million children molesters. As a preventive measure is used Megans Law, which was passed after a neighbor who has repeatedly been convicted of sexual crimes Megan Nicole Kanka girl kidnapped, raped and killed in 1994. Under Megans Law, information about sex offenders is public. That means that anyone who is interested can find out if a pedophile lives in his neighborhood. This is a big help for parents, but the big help for justice would be if that pedophiles do not exit prison. Fact is that they are sick and everyone knows they will do it again. Project: In first case, we have bitten wife and raped child by their husband and father. Woman reported the crimes and after seeing her husband, she was scared to testify. Prosecutor may open the case, using Battered-woman-syndrome where is known that the victims are too scared to talk. Prosecutor can call for a police guarding of victims until case is over, and Mr. Smith can be charged for rape and violence. If the prosecutor manage to prove Mr. Smith`s crimes, Mr. Smith will not soon get out of jail. Otherwise he will get restraining order and Megan`s Law will be accomplished in his case. If prosecutor fails, just based on the womans claims, although she withdrew from the case, the father can get a restraining order against his wife and little girl. In case the victim is completely reluctant to testify the court can issue a subpoena which will compel her to either give the testimony or face jail term. In the second case, widow is faced with a terrible condition. As a prosecutor, I would advise her to try the Victim right regarding sentence. If that does not work, she can try civil suit, Wrongful death. When an individual is criminally billed with the loss of life of another individual, the category of the sufferer can also existing a municipal medical negligence court action. While most situations are prohibited to be tried twice, this is an exemption to that concept. The primary privileges for affected individuals of criminal activity include: The right to be present at lawful privileges proceedings; the right to implement for settlement, the right to be observed and get involved in lawful privileges process, the right to be advised of process and activities in the lawful privileges process, of privileges and solutions, and of available services. Also, the right to security from violence and pestering, the right to restitution from the perpetrator, the right to immediate come back of personal property captured as evidence; the right to a rapid test, and the right to administration of these privileges. For every crime there is a Law that is defending its victims. Prosecutors are doing their best to capture and punish villains and to mark them in the society. Government is doing its best to facilitate the smooth functioning of state institutions in the fight against corruption and crime through the quality of legal decisions and insisting on the application of the law Bibliography 1.
