Extract of sample "Lewis vs Texas Case Brief"

The defendant was charged for killing a particular person, yet the state was unable to prove the identity of the victim that was uncovered and was the center of the case. The remains were scarred beyond recognition, and the argument was made that there was not even a way to determine how long the remains had been buried, thereby negating the opportunity for the defense to prove that Lewis could not have been the one that murdered the victim.

Upon appeal, the Appellate Court sided with the state’s argument that it did not matter whether or not they failed to produce and identify the actual body. The identification of the body, according to legal precedent, is not part of the ‘corpus select of murder. Moreover, that state demonstrates that Lewis had not only confessed to murdering the victim, but that other evidence in the case confirmed that very confession. Also, upon appeal, the stated argued that did produce some of the remains of the victim and that other evidence confirmed that some of the items recovered did belong to the victim. Gain, the court sided with the state and upheld the conviction.
